1. Scope of Validity and Subject of the Contract
1.1. The following General Terms and Conditions of Sale, Delivery, Returns and Payment (“GTC”) apply for account registration and all purchases of goods by the end customer (“you”) in the www.gregsmotorspares.com online shop.
2. Registration
2.1. Registration is required to make purchases in the online shop. This can be done during the ordering process or independently of an order. After registration, we will set up an account for you, allowing you to manage your customer data, such as the delivery address and ETC.
2.2. Only individuals of legal age with the capacity to enter into contracts, legal entities, and business partnerships may register. This requirement also applies to placing orders. If a company is registered as a customer, the individual performing the registration guarantees authorization to represent the company.
2.3. During registration, provide your name, invoice and delivery address, phone number, and email address, and choose a password (“login data”).
2.4. By submitting the completed registration form, you submit a binding offer for the contract’s conclusion relating to account registration. After completing the registration procedure, a welcome email will be sent, finalizing the account registration.
2.5. You guarantee the accuracy and completeness of the provided information. Incorrect or incomplete information authorizes us to terminate and delete your account without notice.
2.6. The account can be terminated and personal data will be deleted immediately, unless statutory provisions require otherwise.
2.7. You are not authorized to disclose login data to third parties. Any unauthorized access or indications of account abuse must be reported immediately.
2.8. There is no entitlement to register or use the online shop, and multiple registrations on www.gregsmotorspares.com are not permitted.

12. Term, Blocking, and Termination of the Account
12.1. Account Duration:
The contract for account registration is established for an indefinite period.
12.2. Termination by User:
You have the right to terminate the account registration at any time without notice.
12.3. Termination by Us:
We reserve the right to terminate the account registration without Notice
12.4. Termination with Cause:
Termination with cause remains unaffected. We may terminate the account registration without notice if:
- You provide incorrect or incomplete details at registration.
- You repeatedly breach other contractual obligations and persist in doing so despite our requests to desist.
12.5. Restriction After Termination:
Upon termination of the contract, you are not entitled to create a new account, including under another name or designation.
4. Concluding a Purchase Agreement
4.1. Process of Purchase Contract Formation:
4.1.1. To initiate the ordering process, place the desired product into the shopping basket by clicking the relevant button.
4.1.2. Before finalizing the order, the contents of the shopping basket are displayed for your review. You can make changes to your order at this stage. We save your orders post-order, and while you won’t have access to them, please carefully review your order before clicking “Place order.”
4.1.3. For payment methods involving payment (e.g., Visa, MasterCard, or any other payment method), placing products on www.gregsmotorspares.com is our offer. You accept this offer to form a purchase contract by clicking the “Place order” button in the shopping basket screen.
4.2. Order Documentation:
4.2.1. You can print your order data immediately after submission. (A copy of the order will be mailed to the email address that as provided at checkout) If you wish to review order documents, contact us via email or telephone, and we will gladly provide a copy.
4.3. Order Modifications:
4.3.1. Orders can be modified before leaving our warehouse or before handover to a freight forwarder, i.e., before the issuance of a shipment number and confirmation of shipment by email.
4.4. Reservation of Self-Delivery:
4.4.1. We reserve the right to cancel the goods are unavailable from a reliable, carefully-selected supplier for reasons beyond our culpability (reservation of self-delivery). In such cases, we commit to promptly informing you of unavailability and issuing a reimbursement for any payment made.
13. Warranties & Returns
13.1. General Return & Warranty:
Electronics doesn’t carry a warranty only if they are Dead on Arrival (DOA). Incorrect installation voids the warranty or any claims.
Body parts must be fitted and tested before spray painting. No warranty or claim will be processed if painted before fitment.
If a fitted part is incorrect, it must be returned to the nearest branch in its original packaging. If undamaged, the part will be exchanged for the correct one.
Damaged or broken parts during the return process will not be refunded.
All returns are processed at Head Office, even if the item was initially shipped to a branch
Refunds are subject to a 15% handling fee and may take 5 to 10 business days to be completed through the original payment method.
13.2. Warranty Period:
Warranty for new items are based on the manufacture of the product or goods.
Greg’s Motor Spares files the warranty or claim on the Client behalf and will be informed about progress updated.
13.3. Options for Subsequent Performance:
In the event of a warranty claim, you have the right to choose between Refund or exchange depending on the General Return & Warranty.
13.4. Claiming:
If you claim for the replacement of a new part supplied by us due to liability for material defects or defects, please provide the original invoices and receipts and the Certified Service center or Garage, With detailed records of installation and documentations of installation.
Own / Backyard installation are subject for investigations and can be denied without notices .
13.5. Warranty for Business Customers:
For business customers, liability for defects in used items is excluded, except in cases of gross negligence or intent.
13.6. Exclusions from Defects:
For clarity, the following circumstances do not justify or constitute defects if they are the cause:
- Natural wear and tear.
- Improper use.
- Inadequate or incorrect care of the goods.
- Unsuitable or improper use.
- Incorrect installation, particularly if the ordered part is clearly not the right one.
- Failure to observe instructions for use.
- Incorrect treatment/handling.
- Failure to remove the battery working with electrical goods
6. Shipping and Delivery
6.1 Shipping in Namibia:
For orders below N$600 for Windhoek Only, the shipping cost is N$60. We provide free shipping for orders exceeding N$600.00, excluding delivery abroad and special parcel types such as bulky items and tires.
No additional transaction fees will be charged when using payment methods such as Visa, MasterCard, or any other payment method
7. Transfer of Transport Risk – Applicable to Business or Customers:
For business customers, the risk of accidental destruction and deterioration of goods during delivery to you once the goods are handed over to the designated transport entity or when the goods depart our warehouses for shipping purposes. The event that occurs earliest in the process is considered the determining factor.
8. Accepting the Goods/Transport Damage
8.1. Transport to Gregs Motor Spares locations:
We utilize 3rd Party services as one of the shipping methods for your order. If you receive a damaged consignment of goods, kindly follow these steps: Lodge a complaint about the damaged goods directly with the location, if possible, and document the degree and extent of the damage. This action will neither restrict nor impact your guarantee rights.
8.2. Refusing Damaged Goods:
You have the option to refuse acceptance of damaged goods. In the event of delivered damaged goods, please reach out to us via telephone, email, or in person at the Gregs Motor Spares Branch. Your cooperation assists us in pursuing claims against the parcel service and enhances our service to you simultaneously.
9. Prices and Payment Methods
9.1. Payment Options:
We provide various payment methods for your convenience. Specific payment methods applicable to each product can be found on the respective product page.
9.2. Pricing Information:
9.2.1. All prices on our online shop are denominated in N$ (Namibian Dollar) and inclusive of statutory value-added tax (VAT).
9.3. Price Validity:
9.3.1. The price of the goods is determined at the moment the order is placed, as indicated in the order confirmation received via email. If items are saved in the shopping basket, their total price is updated to the latest daily price during the ordering process.
9.4. Payment Due:
9.4.1. For purchase contracts between you and us, the total payable amount, including shipping costs, is due immediately. You agree to receive the invoice solely in electronic form.
9.5. Credit Card / Debit Card Payments:
9.5.1. When selecting credit card / debit card as the payment method, click “Place order.” You will be redirected to a secure page where you can choose your credit card / debit card type. Enter the correct card information and confirm the payment. Your card will be charged after the order is completed.
14. Checking the Accuracy of Fit:
We want to emphasize that, despite all due care, occasional incorrect deliveries may occur. Therefore, before installing a part you have purchased, it is your responsibility to visually inspect it by comparing it with the original part being replaced. Check whether the part ordered is genuinely suitable for your car, including matching drill holes and connections. If the purchased part differs in dimensions, shape, or material from the original part being replaced, please contact us for further clarification before installing, adapting, or modifying the part, such as painting. This provision does not affect your warranty rights.
If the part is not checked, Installed, Modify, No warranty and claim will be honored.
15. Disclaimer of Liability
15.1. No Liability for Cases:
We expressly disclaim any liability for intent, gross negligence, and cases of harm to life, limb, or health.
15.2. Limited Liability for Negligence:
In cases of minor negligence, we disclaim liability even if an essential contractual obligation has been breached. Essential contractual obligations are those whose fulfillment enables the performance of the client, and the contractual partner can regularly rely on their fulfillment.
15.3. Exclusion of Certain Damages:
In all cases, we disclaim liability for any lack of commercial success, loss of profits, or indirect damage.
15.4. No Guarantee for Foreseeable Damage:
Even in cases of minor negligence, we disclaim liability for any damage foreseeable at the time the account was concluded.
15.5. Applicability to Agents:
This disclaimer of liability extends to our employees, representatives, and vicarious agents correspondingly.
15.6. General Disclaimer of Other Liability:
We are not held liable for any other claims or liabilities.
16. Vehicle Parts Finder (VPF) – Information Accuracy:
We offer a Vehicle Parts Finder (VPF) to assist you in locating suitable vehicle parts for your specific needs. The VPF utilizes a vast database comprising approximately 3.5 million different links from our suppliers, providing a comprehensive range of automotive components.
Please note that the data provided by the VPF is sourced from our suppliers and is intended to offer a convenient way to identify compatible parts for various vehicles. While we strive for accuracy, it is important to understand that the information provided by the VPF is based on data received from suppliers and may be subject to occasional updates or changes.
We estimate the accuracy of the VPF data to be approximately 95%. It is crucial to verify the compatibility of the identified parts with your specific vehicle before making a purchase. We recommend consulting your vehicle’s manual or seeking professional advice to ensure the precise fitment of any selected parts.
In the event of discrepancies or uncertainties, please do not hesitate to reach out to our customer support for assistance. We are committed to providing you with the most reliable information available and are here to help you make informed decisions regarding your automotive parts needs.
10. Arrears/Right of Retention
10.1. Reminder Charges:
If a payment is overdue, we reserve the right to invoice necessary charges for reminders unless you can demonstrate that no reminder costs were incurred, or these costs are significantly lower than the claimed amount. Each reminder incurs a fee of 15%.
11. Retention of Title
11.1. Security for Purchase Price Claims:
To secure our claims for the purchase price against you, we maintain ownership of all goods delivered until the purchase price is paid in full.
11.2. Obligation for Care:
You are obligated to handle the goods subject to retention of title with care.
11.3. Restrictions on Pledging and Assignment:
Before the secured claims are fully paid, goods subject to retention of title cannot be pledged to third parties or assigned for security purposes. Immediate written notification to us is required if and when third parties gain access to goods belonging to us.
11.4. Additional Terms for Business Customers:
11.4.1. We retain title to all delivered goods until full payment of all current and future claims arising from the purchase contract and ongoing business relationships with you (“secured claims”).
11.4.2. If the realizable value of our securities exceeds the secured claims by more than 15%, we are obligated to release the securities upon your request. The choice of released securities will be determined by us.
11.4.3. Any processing or alteration you perform on the supplied goods is always on our behalf. In the case of processing with other items not belonging to us, we acquire joint ownership of the new item based on the value of the goods delivered (final invoice amount including VAT), expressed as a percentage of the value of the processed items at the time of processing. The new item is subject to the same conditions as goods supplied under reservation.
11.4.4. If the supplied goods are inseparably mixed with other items not belonging to us, we acquire ownership of the new item based on the value of the goods supplied (final invoice amount including VAT), expressed as a percentage of the value of the other mixed items at the time of mixing. If the mixing results in your item being considered the main item, it is agreed that you will transfer proportional ownership to us. You will store the resulting sole or joint property on our behalf.
17. Payment Gateway:
17.1. Card acquiring and security.
Card transactions will be acquired for Greg’s Motor Spares via DPO Group who are the approved payment gateway for Namibian Acquiring Banks. DPO uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website.
17.2. Customer details separate from card details.
Customer details will be stored by Greg’s Motor Spares separately from card details which are entered by the client on DPO’s secure site.
17.3. Merchant Outlet country and transaction currency.
The merchant outlet country at the time of presenting payment options to the cardholder is Namibia. Transaction currency is Namibian Dollar (NAD).
17.4. Payment options accepted
Payment may be made via Visa and MasterCard, or by bank transfer into the Greg’s Motor Spares bank account, the details of which will be provided on request.
INFORMATION REGARDING OF CANCELATION
Cancelation for Consumers:
You have the right to Cancel from the order within 2 days.
The cancel period will expire after 3 days from the day on which you payment has been made, and the order has been shipped.

To meet the cancelation deadline, it is sufficient for you to send your communication concerning your exercise of the cancelation before the period has expired.
Effects of Cancel:
If you cancel from this account, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment method that was ordinally used.
For goods that can normally be sent by us:
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us at Gregs Motor Spares and Gregs Motor Spares Branches. without undue delay and in any event not later than 7 days from the day on which you communicate your cancel the order from us.
For goods that, by their nature, cannot normally be returned by Gregs Motor Spares (e.g. spare parts that are unsuitable for transport):
You will have to bear the direct cost of returning the goods. The cost is estimated to be the invoice value. You are liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
For goods with additional transport safety requirements (batteries, oil, tyres):
If you receive an item with a special notification telling you to keep the packaging material in case of a return, we recommend that you follow the instructions below:
- Keep the sealing plugs used to close the holes and prevent battery or any fluid from leaking;
- Keep the packing materials that protect the battery or fluids case from damage;
- Keep the box that was shipped in with.
If your Gregs Motor Spares package has been damaged, please use new packaging material to return the product to us. As the package contains dangerous goods, make sure to use a sturdy and shock-resistant shipping box. Secure the item against movement within the outer packaging and against accidental activation. Place the item upright in the shipping box and ensure that it cannot move around inside. Use filling material, such as the filling material supplied with the box (If the box had filling material in it) or some newspaper, to fill the empty space between the shipping box and the item.
Damaged hazardous materials, such as leaking batteries, Fluids can be returned to Gregs Motor Spares Branches.
Exceptions from the Cancelation:
There are exceptions to the cancelation , in the context of which we reserve the right to invoke the following to you:
1. Good have already been packed.
2. Good have already been shipped out.
3. Late cancelation
4. Failure to follow proper channels. (Only Head office are allowed to cancel of orders. Not Branches or someone claiming to work for Gregs Motor Spares.)
5. Failure to provide the original invoice.
